The issues facing multiemployer pension and health plans continue to evolve. The special financial assistance program at the PBGC that provided a lifeline to the most deeply troubled multiemployer pension plans is scheduled to wrap up at the end of 2026, but potentially expanded eligibility as a result of court decisions may create timing challenges for PBGC’s review. Executive Orders have rapidly shifted priorities for the federal agencies tasked with oversight of our plans, while layoffs and furloughs of long-time federal employees have left them short-staffed and resulted in a loss of expertise on multiemployer plan issues. While the current Department of Labor took a giant step back from the highly problematic 2025 final mental health parity rule, there remains a continued focus on ensuring access and availability of mental health benefits and plans continue to need guidance on how to comply with parity requirements. And new issues continue to develop as new research from academic experts shines light on the extreme costs to plans and participants of the surprise billing and independent dispute resolution process, while trustees face head-on the eternal question of how best to ensure plans remain well funded long into the future.
